These Terms of Service (“Terms”) govern the relationship between BGM Digital LLC, dba Oscar Hamilton (“we,” “our,” or “us”) and you (“Client” or “you”) for podcast guest booking services provided by us.
By proceeding with our services, you agree to the following terms:
- Booking Guarantee
Oscar Hamilton guarantees to procure and facilitate the number of podcast interview opportunities specified in the Client’s selected package. - Targeted Podcast Placements
We secure interview opportunities on podcasts that are relevant to the Client’s areas of expertise and aligned with the target audience defined during onboarding. - Scope of Services
Our services include identifying appropriate shows, submitting guest invitations on the Client’s behalf, and coordinating interview logistics upon acceptance by the podcast host using the Client’s provided availability calendar. - Quality Standards
Oscar Hamilton works exclusively with well-established podcasts that cater to audiences matching the Client’s defined niche or industry. - Interview Acceptance and Client Cancellations
The Client may decline one (1) podcast interview without penalty, provided the decline is submitted within three (3) business days of receiving the confirmation email from the Booking Account Manager. Declines must be submitted in writing via email reply to the Booking Account Manager. Any declines made after this window, as well as any additional declines, canceled interviews, missed appointments, or interviews not scheduled due to the Client’s delay or inaction, will still count toward the total number of guaranteed bookings and will not be eligible for replacement or refund. - Host-Initiated Changes
If a podcast host cancels or reschedules an interview, Oscar Hamilton will coordinate a new interview date or replace the interview at no additional charge. - Canceled Interviews
If a host cancels an interview and declines to reschedule, Oscar Hamilton will replace that interview at no additional cost to the Client. - Client-Initiated Rescheduling
Clients may request one (1) rescheduled interview per confirmed booking. All rescheduling requests must be submitted with at least two (2) business days’ notice and directed to the Client’s assigned Booking Account Manager. Excessive or last-minute rescheduling may impact host relationships and future booking success. - Client Obligations
The Client agrees to respond to booking-related communications from their assigned Booking Account Manager within seven (7) calendar days of receiving notice that a podcast host has approved them as a guest. Timely responses are essential to maintaining strong relationships with podcast hosts and securing interview dates efficiently.
If the Client anticipates being unavailable for more than seven (7) consecutive calendar days — due to vacation, travel, conferences, illness, or other obligations — they must notify the Booking Account Manager in advance. This allows the booking team to plan accordingly and avoid missed opportunities or scheduling conflicts.
Failure to communicate availability or respond promptly may result in delayed placements or forfeited bookings, which will still count toward the guaranteed total. - Wishlist Requests
Clients are encouraged to submit a wishlist of preferred shows. While Oscar Hamilton cannot guarantee placements on specific shows, we will make commercially reasonable efforts to pursue those opportunities. All booking decisions ultimately rest with podcast hosts and their production teams. - Refund Policy
The Client is eligible for a full refund if requested prior to the start of onboarding and research, which includes any of the following actions: development of the Client’s podcast pitch, creation of the media list, or internal preparation for outreach. Once these steps have been initiated, the service is considered active and non-refundable — even if outreach to podcast hosts has not yet begun.
Once a podcast host confirms interest in having the Client as a guest — regardless of whether the interview has been calendared — the service is fully underway and not eligible for refund.
Oscar Hamilton guarantees the total number of podcast bookings included in the Client’s purchased package. If, at our discretion, we determine that we are unable to fulfill the full number of guaranteed placements, a prorated refund will be issued for each unbooked interview, based on the value of those individual placements minus any applicable administrative or setup fees. - Service Abandonment and Credit
If the Client chooses to pause or abandon the service after onboarding has begun, a credit will remain on file for one (1) calendar year from the date of payment, unless otherwise agreed in writing. This credit may be applied toward any of our services, minus any applicable administrative fees, and is transferable to another individual within or outside the Client’s organization. - Confidentiality
Oscar Hamilton will maintain strict confidentiality regarding any proprietary, confidential, or sensitive information provided by the Client. This obligation shall survive the termination or expiration of this Agreement. - Compensation
The Client agrees to pay Oscar Hamilton the fees set forth in the selected service package. Payment is due in full prior to the commencement of services unless otherwise agreed in writing. - Limitation of Liability
Oscar Hamilton shall not be liable for any indirect, incidental, or consequential damages arising from or related to podcast placements, including but not limited to missed interviews, reputation outcomes, or audience engagement. Our maximum liability under this Agreement shall not exceed the total fees paid by the Client for the Services. - Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles.
In the event of any dispute arising out of or relating to this Agreement, the parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, either party may pursue available remedies in a court of competent jurisdiction located in Pennsylvania. - Updates to These Terms
From time to time, we may make updates to these Terms of Service to reflect changes in our services or business practices. When we do, the most recent version will always be available on our website, with the updated date clearly listed at the bottom. By continuing to use our services after any updates, you’re agreeing to the latest version of the Terms.

1. How many podcasts will I be booked on?
You’ll be booked on the exact number of podcasts included in your selected package. We guarantee it.
2. What types of podcasts will I be featured on?
We place you on podcasts that match your expertise and target audience, based on the info you share during onboarding. All shows are established, relevant, and carefully vetted.
3. Can I say no to a podcast?
Yes — you can decline one (1) podcast interview without penalty, as long as you do so within 48 hours of receiving the confirmation email from your Booking Account Manager. After that, any declined or missed interviews count toward your total.
4. What if a host cancels or doesn’t follow through?
No worries — if a host cancels and doesn’t reschedule, we’ll replace the interview at no cost to you.
5. Can I reschedule an interview?
Yes, you can reschedule each confirmed interview once, with at least 2 business days’ notice. Just let your Booking Account Manager know.
6. What happens if I don’t reply to a booking email?
If you don’t respond within 3 business days, it can delay your placements or even result in a forfeited booking. We also ask that you notify us if you’ll be unavailable for 5 or more business days (e.g., travel, vacation, etc.).
7. What if I need to cancel an interview?
You can cancel one interview without penalty, but additional cancellations count toward your guaranteed bookings and won’t be replaced or refunded.
8. Can I send you a wishlist of podcasts I love?
Absolutely! We can’t guarantee placement on specific shows, but we’ll make every effort to pursue relevant opportunities that align with your wishlist.
9. Do you offer refunds?
You’re eligible for a full refund if you request it before onboarding begins. Once we start developing your pitch, researching shows, or contacting hosts, the service is considered active and non-refundable.If we’re unable to fulfill the total number of guaranteed bookings, we’ll issue a prorated refund for any unbooked interviews — based on the value of each unfulfilled placement, minus any applicable setup or admin fees.
10. What if something goes wrong or we disagree?
We’ll always try to resolve things through a direct and fair conversation. If needed, any legal matters will be handled under the laws of Pennsylvania, USA.
11. Do your terms ever change?
Yes. We occasionally update our Terms of Service to reflect changes in our business or services. The most recent version is always available on our website. We don’t send formal notices, so we recommend checking back occasionally.
